1. Preamble and Definitions

1.1 Purpose

These Terms of Use define the conditions for accessing and using the Link service, published by GO PROTECT.

1.2 Definitions

• "Service": refers to the Link application and all associated features
• "Client" or "User": refers to any legal entity or natural person acting professionally using the Service
• "Account": refers to the User's personal space
• "User Content": refers to data created by the User (quotes, invoices, clients, etc.)
• "Publisher": refers to GO PROTECT, the company publishing the Service

2. Acceptance of Terms

Using the Service implies full and unreserved acceptance of these Terms. By creating an account or using the Service, the User acknowledges having read, understood and accepted these Terms without reservation.

3. Service Description

3.1 Main Features

Link is a business management application available on macOS and iOS that allows you to:

• Create, edit and manage professional quotes
• Generate and track invoices
• Manage a client and contact database
• Create and track projects
• Manage purchase orders and acceptance reports
• Synchronize data between devices
• Generate professional PDF documents
• Have documents electronically signed

4. Registration and User Account

4.1 Account Creation

Using the Service requires creating an account. The User agrees to provide accurate, complete and up-to-date information during registration.

4.2 Login Credentials

The User is solely responsible for the confidentiality of their login credentials. Any use of the Service from their account is deemed to be made by them.

4.3 Reserved for Professionals

The Service is exclusively intended for professional use. By creating an account, the User declares and warrants:

• Acting within the scope of their professional, commercial, artisanal or liberal activity
• Having a valid SIRET number (or equivalent for foreign companies)
• Not being a consumer within the meaning of consumer law

5. User Obligations

The User agrees to use the Service in accordance with its intended purpose and these Terms. They are prohibited from:

• Using the Service for illegal or fraudulent purposes
• Attempting to circumvent the Service's security measures
• Disrupting or overloading the Service infrastructure
• Reproducing, copying or reselling the Service

6. Data Ownership

The User remains the owner of all User Content created via the Service. GO PROTECT does not acquire any ownership rights to this data and commits not to commercially exploit it.

7. Intellectual Property

The Service, its interface, source code, algorithms and documentation are the exclusive property of GO PROTECT and are protected by intellectual property laws.

8. Service Availability

GO PROTECT strives to ensure Service availability 24/7, with an availability target of 99.5% on an annual basis (excluding scheduled maintenance).

9. Limitation of Liability

GO PROTECT shall not be held liable for indirect, incidental or consequential damages, loss of revenue, or data loss due to User negligence. Total liability is limited to amounts paid by the User in the 12 months preceding the triggering event.

10. Termination

The User may terminate their account at any time. GO PROTECT reserves the right to suspend or terminate a User's account in case of Terms violation. Upon termination, the User has 30 days to export their data.

11. Applicable Law

These Terms are governed by French law. In case of dispute, the parties commit to seeking an amicable solution. Failing amicable resolution, the dispute will be submitted to the exclusive jurisdiction of the Commercial Court of Bobigny.
